1. Acceptance of Terms
By accessing or using codewithkamlesh.in and any related services (digital marketing services, training programs, the Digital Marketing Bootcamp, content, and tools — collectively the "Services"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Services.
2. Eligibility
You must be at least 18 years of age (or have parental consent if a minor enrolling in training/bootcamp programs) and legally capable of entering into binding contracts to use our Services.
3. Services Provided
Code With Kamlesh provides: • Digital marketing agency services (SEO, Google Ads, social media, content marketing, web development) • Training programs and certification courses • Digital Marketing Bootcamp (offline + online hybrid) • Free resources (blogs, guides, podcasts) • Consulting & strategy sessions Service descriptions and pricing on our website are illustrative; final scope and price will be confirmed via signed proposal or order confirmation.
4. Account Registration
Some services require account creation (student dashboard, client portal). You agree to: • Provide accurate and current information • Maintain confidentiality of your password • Notify us immediately of unauthorised access • Take responsibility for all activities under your account We reserve the right to suspend or terminate accounts that violate these Terms.
5. Payments & Pricing
Payments are processed via Razorpay. By making a payment, you authorise us (and Razorpay) to charge the amount specified. • All prices are in INR unless stated otherwise • Bootcamp fees: ₹9,999 (single) or installments (2× / 3× as offered) • EMI plans carry no interest or hidden fees • GST will be added where applicable • Late or failed installments may result in seat forfeiture (refer Refund Policy)
6. Refund Policy
**Bootcamp Enrolments:** • Full refund (minus 5% processing fee) if cancelled 7+ days before batch start • 50% refund if cancelled within 7 days of batch start • No refund after batch commences **Agency Services:** • As per signed proposal/SOW. Setup fees are non-refundable • Monthly retainers: 30-day notice for cancellation **OTP/SMS/WhatsApp credits:** non-refundable. Refunds are processed within 7-14 working days to the original payment method.
7. Communications & Marketing
By providing your email/phone, you consent to receive transactional messages (order confirmations, OTPs, lecture reminders). Marketing communications (promotions, blog updates) are sent only with explicit consent. You may opt out anytime by: • Email: clicking "unsubscribe" • SMS: replying STOP • WhatsApp: replying STOP or contacting us directly Transactional messages cannot be opted out of while you have an active service relationship with us.
8. Intellectual Property
All content on our website (text, graphics, logos, course materials, videos, code) is owned by Code With Kamlesh or licensed to us and protected by copyright, trademark, and other IP laws. **You may:** Access for personal, non-commercial educational use during enrolment. **You may not:** Copy, redistribute, sell, sublicense, modify, or create derivative works without our prior written consent. The "Code With Kamlesh", "CWK" and "CWKMSH" marks are trademarks of Kamlesh Singad. Unauthorised use is prohibited.
9. User Content
If you submit testimonials, comments, blog content, or other materials, you grant us a worldwide, royalty-free, perpetual, non-exclusive license to use, modify, and display such content for marketing and business purposes. You warrant that submitted content is original and does not infringe any third-party rights.
10. Acceptable Use
You agree not to: • Use Services for any unlawful purpose • Spam, harass, or abuse other students/staff • Reverse-engineer, scrape, or hack our systems • Share login credentials or recorded course materials • Misrepresent your identity, affiliation, or qualifications • Upload viruses, malware, or harmful code Violation may result in immediate termination without refund.
11. Disclaimers
**Educational Outcomes:** While we strive to deliver high-quality training and have a strong placement track record, we do not guarantee specific income, jobs, rankings, or business results. Outcomes depend on individual effort, market conditions, and other factors. **Service Availability:** Services are provided "as-is" and "as-available". We do not warrant uninterrupted availability, error-free operation, or fitness for a particular purpose, except where required by law.
12. Limitation of Liability
To the maximum extent permitted by law, Code With Kamlesh, its founders, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Services. Our total aggregate liability shall not exceed the amount paid by you for the specific service giving rise to the claim, in the 12 months preceding the event.
13. Indemnification
You agree to indemnify and hold harmless Code With Kamlesh from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your breach of these Terms or violation of any rights of third parties.
14. Termination
We may suspend or terminate your access to Services at any time for breach of these Terms, non-payment, or conduct we deem harmful. Upon termination, your right to use the Services ceases immediately. Sections on IP, Liability, Indemnification, and Disputes survive termination.
15. Governing Law & Disputes
These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved through good-faith negotiation, then mandatory mediation. If unresolved, exclusive jurisdiction lies with the courts of Indore, Madhya Pradesh, India.
16. Changes to Terms
We may revise these Terms at any time. Material changes will be notified via email or website banner. Continued use after such notice constitutes acceptance of the revised Terms.
